Terms of Use

These Terms of Use (the "Terms") set out the conditions for using the mobile application "Onet Connect Tile Match: Yomoe" (the "App") provided by Yomoe Studio ("we", "us"). By downloading or using the App, you are deemed to have agreed to these Terms.
Article 1 (What the App is)
The App is a personal puzzle game in the tile-matching ("Onet" / "Shisen"-style) tradition: you pick two tiles bearing the same design, and if they can be joined by a path with at most two turns, they are removed. Every board is generated on your own device. All ways of playing, including board generation and play itself, are available without a network connection.
The App offers Adventure, Classic, Relax, Endless, Challenge and Custom modes. In Custom mode you can set the number of rows and columns, the number of tile designs, how remaining tiles move after a match, and how many tiles are added over time.
Article 2 (Conditions of use)
1. You shall use the App in compliance with these Terms and applicable laws.
2. Minors should use the App with the consent of a parent or guardian. The App is not directed to children under 13.
Article 3 (Prohibited conduct)
You shall not, in using the App:
(1) copy, modify, disassemble, decompile or reverse-engineer the App;
(2) redistribute, sell, lend or publicly transmit the App or any part of it;
(3) circumvent or disable the App's advertising or billing functions;
(4) place excessive load on our servers or network, or attempt unauthorized access;
(5) engage in conduct that violates laws or public order and morals, or that we otherwise deem inappropriate.
Article 4 (Data management and responsibility)
1. Your progress, records and settings are stored only on your device. We neither hold nor manage them, and cannot restore them.
2. If data is lost through loss, failure, resetting or replacement of your device, uninstalling the App, or a defect in the OS or the App, we bear no responsibility for its recovery.
Article 5 (Advertising)
1. The App displays in-app advertising in order to remain free to use.
2. Advertising is delivered by third-party advertising providers. We do not warrant the accuracy, legality or safety of ad content, of the goods or services offered by advertisers, or of the destinations that ads link to. Any dealings with an advertiser are between you and that advertiser, and we are not a party to them.
3. Handling of information in connection with advertising is governed by our Privacy Policy.
Article 6 (In-app purchase)
1. The App offers a paid in-app item, "Pro Version" (one-time purchase). Purchasing it makes the following available:
(1) No ads: all advertising in the App is removed (the banner at the bottom of the screen, the interstitial shown before a game starts, and the video ads used to replenish items, to reshuffle a stuck board, or to extend time in Challenge mode).
(2) Custom mode: a mode in which you set the rows, columns, number of tile designs, movement rule and tile refill count yourself.
(3) Board themes: four colour themes for the game screen (Matcha, Sakura, Ocean, Night).
(4) Tile designs: two extra sets of tile designs (Numbers & Letters, Animals).
(5) Rewards without video ads: item replenishment, reshuffling a stuck board, and time extension in Challenge mode are granted without watching a video ad.
2. "Pro Version" unlocks nothing other than the above. Adventure, Classic, Relax, Endless and Challenge modes, every stage and difficulty, and the "Fruits & Veggies" and "Mahjong" tile designs are available without restriction in the free version and play identically whether or not you have purchased.
3. Items (hint, shuffle, bomb, extra time) are granted in fixed quantities at the start of each game (3 hints, 1 shuffle, 1 bomb, 1 extra time; quantities may differ by stage or mode). Once used up, they can be replenished by watching a video ad. In Challenge mode, however, only 1 hint is granted and it cannot be replenished. Also in Challenge mode, once per game, when time runs out you may watch a video ad to extend the time and keep playing. If you have purchased "Pro Version", the replenishment or time extension is granted without watching a video ad. The quantities granted, and the per-game usage limits, are identical whether or not you have purchased.
4. Purchases, billing and refunds are governed by the terms and practices of the Apple App Store or Google Play. We do not process payments and are not in a position to decide whether a refund is granted. Please follow the applicable store's procedure for refund requests.
5. Purchased functionality can be restored using the same account (Apple ID / Google account) used at the time of purchase. Transfer between different accounts or different platforms is not possible.
6. If the purchase status is lost through loss of your device or erasure of data, please use the restore-purchase feature in the App.
Article 7 (Changes, suspension and termination of the service)
1. We may change the content of the App, add or remove features, and suspend or terminate its provision.
2. The foregoing includes changes to the composition of features in the free and paid versions (including the scope of features available in the free version). We do not guarantee that the scope of free features, or that free availability itself, will be maintained in the future.
3. For changes that materially affect users, we will give notice a reasonable period before the change takes effect, by posting in the App or by other appropriate means. This does not apply to urgent maintenance, security needs, or requirements of law.
4. Notwithstanding the preceding three paragraphs, for users who have already purchased "Pro Version", we will not make the functionality provided at the time of purchase paid again, nor restrict it.
5. We bear no responsibility for damage arising from changes under this Article, except where paragraph 4 is breached.
Article 8 (Intellectual property)
Copyright, trademark and other intellectual property rights in the App belong to us or to their rightful owners. These Terms grant you a non-exclusive right to use the App within their scope; they do not transfer any intellectual property right.
Article 9 (Disclaimer and limitation of liability)
1. The App is provided "as is". We make no warranty, express or implied, as to its completeness, accuracy, usefulness, fitness for a particular purpose, or freedom from interruption or error.
2. We bear no responsibility for damage arising from use or inability to use the App, except where caused by our intent or gross negligence.
3. Even where we are liable, our liability is limited to the amount you have paid us in connection with the App.
4. This Article does not apply to the extent it would be void under the Consumer Contract Act or other mandatory law.
Article 10 (Changes to these Terms)
We may change these Terms where we deem it necessary. Revised Terms take effect when posted in the App or on the app store, and if you use the App after a change, you are deemed to have agreed to the revised Terms.
Article 11 (Language)
1. The Japanese version of these Terms is the authoritative text.
2. For your convenience we may provide translations into English and other languages. Translations are provided for reference only; in the event of any discrepancy or difference in interpretation between the Japanese version and a translation, the Japanese version prevails.
3. The preceding two paragraphs apply equally to the Privacy Policy and other documents we provide in connection with the App.
Article 12 (Governing law and jurisdiction)
These Terms are governed by the laws of Japan. In the event of a dispute between us and a user in connection with the App, the Tokyo District Court shall be the exclusive court of first instance by agreement.
